Article 1 (Application)

These Terms of Service set forth the terms and conditions for the use of the Mikoshi Carrying Experience Service (hereinafter referred to as “the Service”) provided by Precious Hearts LLC (hereinafter referred to as “the Company”) through the website “https://nippon-culture.com” (hereinafter referred to as “this Website”).

All customers using the Service (hereinafter referred to as “Users”) are deemed to have agreed to these Terms of Service.

Article 2 (Service Details)

  1. The Service provides the opportunity to experience carrying a mikoshi (portable shrine) at a Japanese festival, at the date(s) and location(s) designated by the Company.
  2. Details of the Service (date(s), location(s), fees, plan details, etc.) shall be separately posted on this Website.

Article 3 (Application for Use)

  1. Anyone wishing to use the Service shall apply for use in accordance with the prescribed procedures on this Website.
  2. A service agreement shall be established when the Company approves the application for use.
  3. If a minor wishes to use the Service, the consent of a parent or guardian is required.

Article 4 (Fees and Payment Method)

  1. The usage fees for the Service shall be separately posted on this Website.
  2. Users shall pay the usage fees by the payment method designated by the Company.
  3. If payment of the usage fees is not confirmed by the payment deadline, the Company may cancel the service agreement.

Article 5 (Cancellation)

  1. Users may cancel the service agreement in accordance with the cancellation policy established by the Company.

Article 6 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Service:

  • Acts that violate laws and regulations or are likely to violate laws and regulations
  • Acts that are offensive to public order and morals
  • Acts that infringe on the intellectual property rights, privacy, or other rights of the Company or third parties
  • Acts that interfere with the operation of the Service

Article 7 (Disclaimer)

  1. The Company shall not be liable for any damages incurred by Users in connection with the provision of the Service, except in cases attributable to the Company’s negligence.
  2. Regarding accidents, injuries, theft, etc., at the festival, the Company shall not be held liable in principle. However, insurance benefits may be paid within the coverage of the visitor travel insurance provided by Sompo Japan Insurance Inc. Please note that the terms and conditions of the insurance contract shall apply to the payment of insurance benefits.
  3. The contents of the Service may be changed or canceled due to bad weather, delays in transportation, or other unavoidable circumstances. In this case, the Company may refund part or all of the usage fees, but shall not be liable beyond that.

Article 8 (Compensation for Damages)

If a User violates these Terms of Service or causes damage to the Company through fraudulent or illegal acts, the Company may claim damages from the User.

Article 9 (Handling of Personal Information)

The Company shall appropriately handle Users’ personal information in accordance with the privacy policy separately established by the Company.

Article 10 (Changes to the Terms of Service)

  1. The Company may change the contents of these Terms of Service as necessary.
  2. The revised Terms of Service shall become effective when posted on this Website.

Article 11 (Governing Law and Jurisdiction)

  1. These Terms of Service shall be governed by the laws of Japan.
  2. Any and all disputes relating to these Terms of Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
